Litigation Financing:  An Introduction
Litigation finance is a relatively new but simple idea. Investors provide funding to cover the costs of a case in return for payment if the case is won. The return comes in the form of a multiple of the funding commitment offered in the first place. Not very long ago, such funding arrangements were held to be unlawful. But it is now recognized that without third-party funding many claimants would not be able to afford to pursue valid claims, thus serving a useful social purpose by providing access to justice.  However, not everyone agrees. This session will explore the influence litigation financing has on litigation and some of the ethical questions that have arisen as its use has become more widely embraced.
