We have made it a priority to stay informed and knowledgeable on the latest inbound and outbound investment laws and regulations, allowing us to focus on helping our clients understand cross-border business activities and the regulatory regimes, national and international, that apply to them. We can assist with exchange control (financial surveillance) applications, international trade transactions, new company formations, immigration matters, the set-up of cross-border corporate structures, and with drafting and providing insightful advice on a wide range of commercial agreements, service and employment agreements, licenses, distribution agreements, and cross-border arbitration matters.

We endeavor to make the legal and financial aspects of commercial transactions as uncomplicated as possible for our clients, not only when investing in South Africa but many other regions in Africa as well. Our firm has been involved with major players investing on the African continent, specifically in the renewable energy sector. The Department of Energy in South Africa has expanded the investment opportunity in renewable energy in South Africa from a few hundred million dollars to a multi-billion dollar industry. The South African government is also working on preparations for rolling out a nuclear energy program, with a decision to call for bidders to build a new nuclear plant or plants set to be made within the current financial year. There are a number of property investment opportunities in South Africa as well.

The South African Government has devoted much effort to developing its incentive programs by developing an “incentive program portal” online, dividing state incentives into three broad categories: (1) concept, research and development incentives; (2) capital expenditure incentives; and (3) competitiveness enhancement incentives, all in all displaying South Africa’s eagerness to attract investment. It is no secret that Africa has some of the strongest emerging economies and at VDMA we pride ourselves on conducting and servicing the legal aspects of transacting business in South Africa and Africa, helping to fuel the expansion of these emerging economies.
