August 2019: Dominican Republic member firm Guzmán Ariza managing partner Fabio Guzmán Ariza recently released a new book on Dominican Republic real estate law, entitled Ley 108-05 de Registro Inmobiliario, con sus Modificaciones, Reglamentos y Normas Complementarias, Concordados e Indexados. The release was held at the National Library of the Dominican Republic, with government officials and members of the judiciary, as well as colleagues, partners and relatives, in attendance. A lawyer, writer, editor and linguist, Mr. Guzmán Ariza is president of the editorial board of Gaceta Judicial and numerary member of the Dominican Academy of the Language and member of the Spelling Commission and the Lexicographical Research Team of the Royal Spanish Academy in Madrid, Spain. He graduated from the Massachusetts Institute of Technology and was awarded his law degree by Pontificia Universidad Católica Madre y Maestra. Chambers and Partners, the world’s most prestigious legal rating agency, recently named him a “senior statesman” of Dominican law.
October 2018: Dominican Republic member firm Guzmán Ariza President and Managing Partner Fabio Guzmán Ariza has been named “senior statesperson” in the 2019 edition of Chambers Latin America in recognition of his more than 35 years of service, advising international clients on real estate and tourism matters in the Dominican Republic. Chambers has only conferred this honor on three other Dominican attorneys since it began publishing its rankings of Dominican firms and legal practitioners. In addition to the firm’s rankings in the Latin America-wide categories of real estate and tourism, dispute resolution, and environment, Christoph Sieger was singled out for special recognition in real estate and tourism and Giselle Pérez Reyes was acknowledged for her expertise in environmental law. The firm was also listed as a “top-tier firm” in real estate and tourism in the Dominican Republic by the Legal 500, and Messrs. Guzmán Ariza and Sieger were also named “leading lawyers” in the field. Fabio Guzmán Saladín, a member of the SCG Legal board of directors, was also recognized for the second time as a “next generation lawyer” in corporate and finance.
April 2018: Dominican Republic member firm Guzmán Ariza has been retained to represent Pan Am World Airways Dominicana in the first major bankruptcy proceeding in the Dominican Republic under the country’s new mercantile restructuring law, a process which will involve hundreds of national and international creditors. The Restructuring Court in Santo Domingo accepted the firm’s bankruptcy filing request and has authorized preliminary proceedings to begin. Partners Fabio Guzmán Saladín, Alberto Reyes and Rhadaisis Espinal lead the legal team assisting PAWA. In January 2018, without prior notice, the Civil Aviation Authority of the Dominican Republic suspended PAWA’s operations for a period of 90 days, alleging nonpayment of airline and airport fees, leaving thousands of passengers stranded across the Caribbean. Within days, the airline was left with no choice but to file for bankruptcy. PAWA Dominicana is the international flag carrier of the Dominican Republic, with scheduled flights to multiple destinations in the Caribbean and the U.S.
January 2018: Fabio Guzmán Saladín and Pamela Benzán Arbaje of Dominican Republic member firm Guzmán Ariza have coauthored the Dominican chapter of Getting the Deal Through: Restructuring & Insolvency (2018), which provides a comparative analysis of restructuring and insolvency regulations across the globe, with answers to questions in key areas such as applicable legislation, excluded entities, secured lending and credit, competent courts, voluntary liquidations and reorganizations, involuntary liquidations and reorganizations, and doing business during reorganizations, among others. It is published by Law Business Research.
June 2017: Dominican Republic member firm Guzmán Ariza represented Sunwing Travel Group in one of the largest non-syndicated financings granted by Banco del Reservas in the Dominican Republic. The facility will be used by Sunwing Travel Group to complete the construction of the Royalton Bávaro Resort & Spa, at an estimated total investment of $200 million (USD), which is expected to generate thousands of jobs. The new Blue Diamond Resorts complex, a subsidiary of Sunwing Travel Group, will be the third Royalton resort in the country and the first under the Royalton Luxury Resort flag. The 730-room resort will be built on Arena Gorda Beach and will operate under its signature All-in Luxury® concept. Guzmán Ariza has assisted Sunwing Travel Group since 2013 in arbitration, project finance, and investment matters, as well as in commercial contracts and litigation.
